Mind Tech - Terms of Use

1. General Provisions

These Terms of Use (hereinafter referred to as the “Terms”) govern the use of the MindTech Waiter mobile application (hereinafter referred to as the “Application”).

By using the Application, the user confirms that he/she has read and agrees to these Terms.

2. Purpose of the Application

The application is software for automating guest service processes in catering establishments.

The application is intended solely for official use by employees of organizations and provides the following functionality:

• receiving and processing calls from desks;
• automatic distribution of tasks between staff;
• administration of employees and service points;
• service activity analysts;
• voice input of an order with subsequent text processing.

The application is not a consumer service for the end guests of the establishment.

3. Registration and access

3.1. Access to the Application is provided to users registered by the director of the relevant institution.

3.2. The User undertakes to:

• use only the credentials provided to him;
• don't share your login and password with third parties;
• ensure the security of authentication means;
• immediately notify the administrator of unauthorized access

3.3. The operator has the right to temporarily restrict or terminate user access in the event of:

• violation of these Terms;
• suspicion of unauthorized access;
• threat to system security.

4. Ограничения использования

It is prohibited:

• decompile, modify or distribute the Application;
• attempt to bypass security mechanisms;
• use the Application beyond its intended purpose;
• interfere with the operation of the server infrastructure;
• use the recording functionality to illegally collect information.

5. Интеллектуальная собственность

All exclusive rights to the Application, including the program code, design, architecture and server solutions, belong to MIND TECHNOLOGY LLP.

Use of the Application does not grant the user ownership of the software.

6. Ограничение ответственности

The application is provided "as is".

The operator does not guarantee:

• no technical errors;
• uninterrupted operation of the service;
• Compatibility with all devices;
• absolute accuracy of automatic processing of voice data.

The operator is not responsible for:

• user actions;
• incorrect use of functionality;
• Internet connection interruptions;
• temporary unavailability of the service;
• losses arising from the use of the Application.

7. Прекращение доступа

The Operator reserves the right to suspend or terminate access to the Application without prior notice in the event of:

• violation of these Terms;
• identifying security threats;
• legal requirements;
• abuse of recording or geolocation functionality.

8. Изменение Условий

The Operator reserves the right to change these Terms.

The current version is posted on the official website.

Continued use of the Application after changes have been made constitutes acceptance of the updated version.

9. Применимое право

These Terms are governed by the laws of the Republic of Kazakhstan.

Disputes are resolved in accordance with current legislation.
